Rescheduling Policy

Bookings of a “chauffeur driven car, hourly and at disposal service”, transferred by the customer more than 24 hours before the commencement date Golden Riviera  “chauffeur driven car, hourly and at disposal service” will incur no transfer fee.

Golden Riviera “chauffeur driven car, hourly and at disposal service” rescheduled by the customer within 2 to 24 hours of the commencement date will incur a Thirty percent (30%) transfer fee of the total of the invoice due.

Cancellation Policy

Cancellations by customers made more than 24 days before Golden Riviera “chauffeur driven car, hourly and at disposal service” commencement will not incur cancellation charges.

Cancellations within 8 to 24 hours of Golden Riviera “chauffeur driven car, hourly and at disposal service” commencement will incur a fifty percent (50%) cancellation fee of the total invoice agreed, between 0 and 8 hours will incur a one hundred percent (100%) cancellation fee of the total invoice agreed.

  1. Definitions

These are the terms and conditions governing the provision of our professional services or its subcontractors with the exclusion of any other oral or written statement or agreement whatever its legal character.

1.1. Client or Customer means a company or individual that requires a professional service or enters into a contractual arrangement.

1.2.  “Invoice” means an invoice for  Golden Riviera “chauffeur driven car, hourly and at disposal service” proposed by us to the customer.

1.3. The “chauffeur driven car, hourly and at disposal service”, is a service provided by Golden Riviera to Customer.

The service implies a provision of a car, chosen by Customer, with a professional chauffeur.

1.4. A professional chauffeur is an employee or subcontractor owning a Chauffeur professional license.

1.5.VAT is the Value Added Tax payable by customer. The VAT appears on every invoices released by Golden Riviera to customer.

  1. General

These Terms and Conditions shall apply to all Customer in the provision of “chauffeur driven car, hourly and at disposal service” by Hub Agency to the Customer in accordance with any order confirmation authorized by the Customer.

No additions to, or modifications of, these Terms and Conditions shall have effect unless expressly agreed in writing by both parties and expressed to be amendments to these Terms and Conditions.

Our employees or agents are not authorized to make any representations whatsoever concerning the provision of services unless confirmed by Hub Agency in writing. The Customer acknowledges that it does not rely on, and waives any breach of, any such representations that are not so confirmed.

1.1. The chauffeur driven car, hourly and at disposal service may be contracted per hour with a minimum of invoicing of four (4) hours.

1.2. The “chauffeur driven car, hourly and at disposal service” may be contracted per package of hours. Two (2) packages of hours are available to Customer: a package of Six (6) hours, a package of Ten (10) hours.

1.2.1. It is not possible to split the package of hours during its process. A package starts each day while the car leaves its garage and can not be stopped until the end of its service booked by customer.

1.3. In case of extra hours exceeding a package of hours, Hub Agency will charge the full price of a single hour, per extra hour made by Customer.

1.4. The waiting time is the time that the car and its chauffeur wait for Customer while the package of hours is in process. Hub Agency will refuse any reimbursement of any waiting time caused by Customer.

1.5. The “chauffeur driven car, hourly and at disposal service” stars when the Car and its chauffeur leaves the Hub Agency or sub contractor’s garage. The service ends when the car and its chauffeur are returned to the Hub Agency or subcontractor garage.

1.6. In order to respect the Private Transportation French Regulations, The Customer must confirm any “chauffeur driven car, hourly and at disposal service” by written notification through: online form, letter, fax, email or SMS to Hub Agency, before the execution of the service.

1.8. The “chauffeur driven car, hourly and at disposal service” includes gas and toll fees within 150Km radius (93mi).

1.9. In regards of “chauffeur driven car, hourly and at disposal service” exceeding Ten (10) continuous hours, Customer will be charged an amount of Twenty (20) Euros for the chauffeur meals.

1.10. Customer will be invoiced a Twenty percent (20%) for all “chauffeur driven car, hourly and at disposal night time service” rendered between 21:00 (9pm) and 7:00 (7am)

  1. Acceptance of order

3.1. Bookings can be accepted at any time, up to the Hub Agency “chauffeur driven car, hourly and at disposal service” start date, subject to availability.

3.2. A 50% deposit must be received from the Customer in order to reserve a Hub Agency “chauffeur driven car, hourly and at disposal service”.

3.3. Bookings can solely be made by the payment of a 50% deposit online form, letter, fax or email. Bookings are only confirmed once we have received the 50% deposit Funds. While the payment is made, Hub Agency will return a formal invoice.

  1. Substitutions, Rescheduling and Cancellations.

4.1. Bookings rescheduled by Customer within 2 to 24 hours of the commencement date of the Hub Agency “chauffeur driven car, hourly and at disposal service” will incur a Thirty percent (30%) transfer fee of the total of the invoice due.

4.2. Bookings transferred by Customer more than 24 hours before the commencement date of the Hub Agency “chauffeur driven car, hourly and at disposal service” will incur no transfer fee, however the transferred Hub Agency “chauffeur driven car, hourly and at disposal service” must be completed within one (1) month of the commencement date of the original Hub Agency service.

4.3. In the event that a customer cancels a booking for which a transfer has taken place, this will incur a minimum of Fifty percent (50%) cancellation fee of the total of the invoice due.

4.4. In all circumstances we require written notification of any transfers, rescheduling and cancellation.

4.5. Cancellations by customers made more than 24 hours before hub Agency “chauffeur driven car, hourly and at disposal service” commencement will not incur cancellation charges.

4.6. Cancellations within 0 to 8 hours of Hub Agency “chauffeur driven car, hourly and at disposal service” commencement will incur a Hundred percent (100%) cancellation fee of the total invoice due, between 8 and 24 hours will incur a fifty percent (50%) cancellation fee of the total invoice due.

4.7. In all circumstances, we require written notification of any cancellations.

4.8. We undertake to provide the professional services on the date specified except when external circumstances prevent this.     In these circumstances we will endeavour to re run the professional services on a mutually agreeable basis.

4.9. We reserve the right to cancel a professional service, though we make every effort to ensure this does not occur. In the event of a professional service being cancelled by us, alternative dates will be proposed or a full refund of monies paid will be made to the customer.

4.10. We take no responsibility for loss of profit and/or for any incidental, consequential special or indirect losses as a consequence of exceptional cancellations.

  1. Pricing and Payment terms

All professional services fees are fixed and published by Hub Agency; however, Hub Agency reserves the right to review and change the prices.

  1. Limitation of Liability and Indemnities

6.1. Except as may otherwise be expressly provided in these Terms and Conditions, all warranties, conditions, terms, undertakings and representations of any kind whatsoever, express or implied, whether by statute, common law or otherwise, are hereby excluded by Hub Agency to the fullest extent permitted by law and we shall have no other obligation, duty or liability whatsoever in contract, tort, statute or otherwise to the Customer.

6.2. Hub Agency represents and warrants that the service provided will be performed in a professional and skilful manner consistent with the professional standards and the general customs and practices of the Professional Services industry.

6.3. We maximum aggregate liability for any and all losses, claims, demands, damages, costs and/or expenses of any kind whatsoever arising out of or in connection with any order confirmation and/or these Terms and Conditions (whether in contract, tort, by statute or otherwise) shall not, in total, exceed the amount actually paid by the Customer to us for the services which are the subject of the order confirmation in question.

6.4. Without prejudice to the generality of the foregoing, we shall not be liable to the Customer (whether in contract, tort, by statute or otherwise) for loss of profits and/or for any incidental, consequential, special or indirect loss or damage arising out of or in connection with any order confirmation and/or these Terms and Conditions.

6.5. For the avoidance of doubt, neither the types of loss and/or damage through neither inclusive nor any similar types of loss and/or damage shall constitute direct loss for the purposes of these Terms and Conditions and/or any order confirmation.

6.6. For the avoidance of doubt, nothing in these Terms and Conditions and/or any order confirmation shall restrict and/or exclude in any way Hub Agency liability for (a) death or personal injury resulting from the negligence of Hub Agency, its officers and/or

employees; and/or (b) fraudulent misrepresentation. The Customer is liable for any loss, damage or injury to Hub Agency’s staff or their property which may arise whilst working at the Customer location and is due to negligence or breach of statutory duty by the Customer.

6.7. Hub Agency accepts no liability for the failure of any third party hardware, software and/or systems which may be the subject of any Hub Agency services.
